1. Age Requirement
You must be 18 years of age or older to use this platform. Drinking-related game modes require participants to be 21 or older, or the legal drinking age in your jurisdiction if higher. By entering your year of birth and confirming, you represent that you meet this requirement.
2. Permitted Use
This platform is for personal, non-commercial entertainment use. You may not use it to harass, exploit, or harm other people. You may not attempt to circumvent age gates, extract content for redistribution, or interfere with the platform's operation.
3. Consent and Player Responsibility
All games involve voluntary participation. Players are responsible for obtaining the meaningful, ongoing consent of everyone involved before engaging in any prompt, dare, or challenge, particularly those involving physical contact. In-game consent prompts are tools to support this, not a substitute for genuine communication. Pass or skip any prompt at any time with no penalty.
4. Content Policy
All platform content is subject to our content policy: no content involving minors, no content designed to degrade or humiliate individuals, and no non-consensual scenarios. Adult and explicit content is accessible only after age confirmation. Heat tier selection is the player's explicit choice.
5. No Accounts
This platform operates without user accounts, sign-up, or passwords. You are not creating a profile. Display names entered in multiplayer lobbies are temporary identifiers for that session only. Most Likely To, Gilded Tongue, Two Truths & a Lie, Charades, and Trivia support multiplayer rooms. Other games are pass-and-play on a single device.
6. No Warranties
This platform is provided "as is" without warranties of any kind, express or implied. We do not guarantee uninterrupted availability, accuracy of content, or fitness for any particular purpose.
7. Limitation of Liability
To the fullest extent permitted by law, Ember & Ace and its operators are not liable for any indirect, incidental, special, or consequential damages arising from your use of the platform, including outcomes of gameplay between participants. In no event shall Ember & Ace's total cumulative liability exceed one hundred United States dollars (US $100.00).
8. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Nevada, United States, without regard to conflict of law principles.
Any dispute, claim, or controversy arising out of or relating to these Terms or your use of the platform shall be resolved through final and binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, on an individual basis and not as a class, collective, or representative action. The seat of arbitration shall be Las Vegas, Nevada. This arbitration clause does not prevent either party from seeking injunctive or other equitable relief from a court of competent jurisdiction in Nevada for intellectual property infringement or misuse.
9. Changes
We may update these Terms as the platform evolves. Continued use after changes constitutes acceptance. The date at the top of this page reflects the most recent revision.
